"The use of the term 'hate speech' has an extremely dangerous chilling effect on free speech because the right of free speech is not limited to speech deemed to be politically incorrect," said the complaint filed by three professors.

"If free speech can be used to discriminate against a particular class of speakers, it may therefore also be abused to deny other groups equal protection," they said, including immigrants who are unable to legally obtain government aid under current law. "These and other claims have been made before in this case by the American Civil Liberties Union, the NAACP Legal Defense Fund and the American Civil Liberties Union of Southern California."

The complaint also cites the 2010 ruling of the United States Court of Appeals for the Ninth Circuit in U.S. v. Pacifica Foundation for Reproductive Health in California, in which the majority ruled that businesses have no "right" to exclude a woman from speaking out about an issue she finds controversial in California.

In his memo, Mr. Obama said: "In the last year, we have seen unprecedented examples of corporate entities engaging in the politics of fear in our economy. We have seen a surge in anti-immigrant policies by businesses that seek to reduce the social safety net, including by seeking to pass nondiscrimination regulations that have the potential to further chill their business activities. And we have seen powerful businesses exploit the vulnerability of a vulnerable population — workers at companies that use federal contracts, including many in Silicon Valley — to push to lower wages and benefits."

The complaint contends the Trump administration should reject those guidelines as a violation of free speech.

"While the Trump administration may take issue with the principles behind the Pacifica Foundation for Reproductive Health ruling, the ruling itself does not deny companies or their employees an option to do business with the United States, which is protected by the First Amendment of the Constitution," the professors said. "In fact, Congress expressly allows the Trump administration to protect the federal government from actions that would hurt jobs, companies and jobs."
